These terms govern your use of the IncidentKit marketing website.

1. Acceptance and scope

These terms govern your use of the public marketing website at incidentkit.ai (the “Website”), operated by IncidentKit (“IncidentKit,” “we,” “us”). By using the Website you agree to them. If you do not agree, do not use the Website.

These terms do not apply to the IncidentKit application at app.incidentkit.ai, which is governed by separate service terms.

2. Eligibility and audience

The Website is intended for healthcare professionals, facility administrators, safety and compliance professionals and others interested in IncidentKit. You must be at least 18 years old. If you use the Website for an organization, you confirm you may bind it to these terms.

3. Permitted use

We grant you a limited, non-exclusive, revocable license to use the Website for lawful, informational purposes. You agree not to:

  • Use the Website unlawfully or in violation of regulation.
  • Attempt to gain unauthorized access to the Website, its servers or connected systems.
  • Use bots, scrapers or crawlers to extract or reproduce content without written permission, other than search engines and AI assistants that honor our robots.txt.
  • Interfere with the integrity, performance or security of the Website.
  • Submit protected health information, patient data or clinical documentation through any form or message on the Website.
  • Impersonate any person or misrepresent your affiliation.
  • Transmit malware, spam or other harmful content.
  • Reproduce or create derivative works from the Website or its content without written consent, except as the law permits.

4. Intellectual property

The Website's content, including text, graphics, logos, layouts, tools, templates and code, belongs to IncidentKit or its licensors and is protected by intellectual property law. IncidentKit, the IncidentKit mark and wordmark, and Lauren are names and marks used by IncidentKit. You may not use them without written permission.

Templates and calculators may be used inside your organization for your own incident reporting. You may not resell them or republish them as your own.

5. Submissions and feedback

If you send feedback, suggestions or other submissions, you grant IncidentKit a non-exclusive, royalty-free, perpetual, worldwide license to use them for any purpose without compensation. You confirm they do not infringe anyone's rights.

6. No medical, legal or professional advice

Nothing on the Website is medical advice, legal counsel, a compliance certification or regulatory advice. Guides, templates and calculators are general information. Rules change and apply differently by setting and jurisdiction: confirm requirements with the issuing body or your counsel before relying on any summary.

7. Product descriptions, comparisons and availability

Descriptions of IncidentKit are informational and illustrative. Some capabilities are marked “rolling out” and are being released in stages. Features, pricing and availability can change without notice and are not a binding offer, commitment or warranty.

Comparisons with other products reflect public information at the date shown on each page. Products change; verify details with the vendor. If you find an error, email hello@incidentkit.ai.

THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT THE LAW PERMITS, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS AND AVAILABILITY.

10. Limitation of liability

TO THE MAXIMUM EXTENT THE LAW PERMITS, IncidentKit AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE WEBSITE.

THE TOTAL AGGREGATE LIABILITY OF THE IncidentKit PARTIES FOR ALL CLAIMS RELATED TO THE WEBSITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless IncidentKit and its affiliates, officers, employees, agents and service providers from claims, losses and expenses arising from your use of the Website, your violation of these terms, your submissions or your violation of any third-party right.

12. Governing law and disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Disputes arising from these terms or the Website will be resolved exclusively in the state or federal courts located in Delaware.

13. Changes

We may update these terms at any time. When changes are material we will update the date on this page. Continued use of the Website after changes means you accept them.
